Lawsuit For Parkinson’s Disease

About The Paraquat Mdl

Neurology – Topic 13 – Parkinson’s disease female patient

In 2017, there were almost 400 lawsuits against paraquat manufacturers. With the influx of claims that followed alleging the same or similar harm, hundreds of paraquat lawsuits were consolidated into multidistrict litigation in July 2021. Consolidating cases this way means theres one judge and one forum for filing claims in this case, thats the U.S. District Court of the Southern District of Illinois.

The latest numbers indicate that 681 lawsuits are pending in the MDL that claim failure to warn and that the herbicide manufacturers were aware or should have been aware of the known risks. It allows the discovery process, pre-trial motions, and scheduling of hearings on plaintiffs and defense motions to be heard in one court.

To become part of the paraquat MDL, potential plaintiffs are given a questionnaire to assess:

  • Extent and type of exposure
  • Diagnosis or history of Parkinsons disease
  • Family history of neurodegenerative diseases
  • Financial damages

There are also many class action lawsuits that involve plaintiffs who were exposed to paraquat and developed Parkinsons disease. Unlike multidistrict litigation, where each claim is seen as separate, class actions are a single lawsuit, and the verdict applies to everyone taking part in the claim.

Paraquat Exposure Linked To Parkinsons Disease

This toxic herbicide has been linked to many side effects, including Parkinsons disease.

While paraquat has been banned in 32 countries across the world, including the European Union and China, it has not been banned in the United States yet. In fact, the use of paraquat in the U.S. has only continued to grow in recent years.

According to the U.S. Environmental Protection Agency , paraquat is one of the most widely used herbicides in the nation. Nearly 11 million pounds of the herbicide are sprayed on U.S. crops each year.

What To Know About Paraquat Lawsuits

Nuplazid Side Effects

People who have filed lawsuits against Paraquat have done so primarily due to the development of Parkinsons disease after exposure. Other people have filed lawsuits due to additional health conditions including kidney failure and disease. The earliest Paraquat lawsuits were filed in 2016. Some of the lawsuits filed against the company are class-action lawsuits while others are individual cases.

Most individuals who have filed lawsuits have done so as a result of years of exposure to Paraquat. For example, farmworkers and agriculture workers are at an increased risk of the development of Parkinsons and other negative health effects due to greater exposure to the herbicide Paraquat.

If you were exposed to Paraquat or lived near a location that regularly used Paraquat, you may be entitled to compensation for personal injuries. Contact Florin|Roebig to see how we can help.

Timeline Of Research Showing The Effects Of Paraquat Exposure

Over the past 20 years, the scientific community has stepped up its examination of the effects of Paraquat exposure on humans–and specifically the risk of Parkinson’s disease.

1980s: MPTP-Parkinson’s Experiment

An experiment in Southern California revealed that MPTP, a heroin contaminant, caused users to suffer symptoms like those associated with Parkinson’s disease. The experiment showed that the heroin contaminant destroyed dopamine neurons, the same neurons that suffer damage in Parkinson’s disease patients. MPTP and Paraquat share similar chemical structures.

1997: Environmental Protection Agency

The EPA announced that exposure to Paraquat during the mixing, loading, and application of the herbicide and the post-application process represented the primary route of exposure to the chemical compound. The agency further suggested that despite the herbicide not being registered for residential use, such exposure is possible for individuals who live near farms where the herbicide is utilized.

Revealed that any exposure to Paraquat within 1,600 feet of a home resulted in a heightened Parkinson’s disease risk of 75 percent.

2011: Environmental Health Perspectives, in association with the National Institute of Environmental Health Sciences

2014: Annual Review of Pharmacology and Toxicology

2016: Environmental Protection Agency

The EPA announced plans to re-evaluate Paraquat, including the herbicide’s potential link to Parkinson’s disease.

Unfortunately, many individuals have developed Parkinsons disease as a result of paraquat exposure, including those who live near agricultural areas where the harmful chemical is used. The widespread use of the substance makes it especially unsettling, as many farmers heavily rely on paraquat without understanding its destructive effects. Paraquat Parkinson’s Disease Lawsuit Update July 5, 2022

In June 2020, Bayer announced it agreed to pay more than $10 billion to settle current and future claims that Roundup caused non-Hodgkins lymphoma and other cancers. Prior to settling, the manufacturer faced more than 120,000 lawsuits alleging that Bayer failed to warn the public that its product contained known carcinogens linked to the development of certain types of cancer.

In addition to this massive settlement, previous jury verdicts against Bayer and the former Roundup manufacturer Monsanto awarded victims more than $2.3 billion in damages covering medical expenses, lost wages, and pain and suffering. However, some of these verdicts were later reduced by judges on appeal.

As of mid-2022, many victims have started receiving the first Roundup settlement checks, with subsequent disbursements to follow. The exact amount that each individual plaintiff will recover depends on a variety of factors including severity of injury, level of Roundup exposure, and the type of cancer involved. However, legal experts expect that these Paraquat lawsuit settlements will pay out an average of $100,000 to $150,000.

Did it ever make any sense to you that Paraqaut would only cause Parkinsons disease? Of course not.

While the number of Paraquat Parkinsons disease lawsuits continues to grow, new research from UCLA suggests that regular residential use of pesticides is associated with an increased risk of thyroid cancer. The study results, which were published last month, looked at 29 different types of pesticides and found that Paraquat had one of the strongest causal associations with thyroid cancer. Individuals who used Paraquat regularly over a 20-year period had a 46% increase in the rate of thyroid cancer.

Epa Regulatory Filing On Paraquat

In March 2016, the Environmental Protection Agency announced in a regulatory filing that they would be further exploring the possible health risks associated with Paraquat.

The filing is part of a program, sponsored by the EPA, that re-evaluates all pesticides on a 15-year cycle.

In the announcement, the agency said, There is a large body of epidemiology data on paraquat dichloride use and Parkinsons disease.

The EPA plans to decide whether to place Paraquat on the banned substance list or continue to allow the chemical to be sprayed on US cropland – but a final decision is not expected until next year at the earliest.

All documents related to the registration review can be located in docket number EPA-HQ-OPP-2011-0855 located at www.regulations.gov.

What Is Paraquat Poisoning

First used in the 1960s, paraquat dichloride is a highly toxic herbicide used commercially to prevent weed and grass growth near farms and crops. In fact, paraquat is so toxic that a single sip can be lethal and theres no known antidote.

Paraquat poisoning can occur if an individual:

  • Inhales or ingests paraquat
  • Comes into contact with sprayed plants
  • Gets paraquat on their skin
  • Mixes, loads, or applies paraquat

Because of its high toxicity, paraquat purchased in the U.S. has several safeguards added to it to help prevent people from accidentally consuming it.

These safeguards include a:

  • Blue dye to distinguish it from beverages
  • Chemical agent that induces vomiting if drank
  • Strong odor for caution

When purchased from outside of the U.S., paraquat may not have these additional safeguards, making accidental consumption a greater risk. But these precautions dont help those who were exposed to paraquat on the job or who live or lived near a sprayed area.

If youve been recently diagnosed with Parkinsons disease and believe it may have been caused by paraquat poisoning, Sokolove Law may be able to help you. Reach out to us today for a free consultation to learn more about your options.

Who Is Most At Risk For Developing Parkinsons Due To Herbicide Exposure

Paraquat Lawsuit Update: The Alleged Connection Between Paraquat and Parkinson’s Disease

Anyone who was exposed to the herbicides containing paraquat could be at risk, but the elevated risk population includes those who had the most frequent exposure.

Those with an elevated risk for developing herbicide-related Parkinsons disease include:

  • Tractor operators, herbicide sprayers, and those who used manual pumps for paraquat application
  • Rural and farming community residents

Others who may have been inadvertently exposed to these herbicides could be unaware that they were exposed at all. Children attending schools or people employed in other businesses near farms in the area could be affected by a contaminated water supply due to herbicide runoff.

Va Review Of Evidence On Health Impact Of Camp Lejeune Water

In 2012, Congress passed a new law that directed the Department of Veterans Affairs to provide special health benefits to former residents of the Camp Lejeune Marine Corps base. These special additional benefits were intended for treatment related to medical conditions and diseases that these veterans may have developed from exposure to the contaminated water at Camp Lejeune.

To help the VA administer these benefits it became necessary to determine what diseases and health conditions were potentially related to the Camp Lejeune water contamination. To identify what diseases were linked to the Lejeune water, a special panel of experts was formed and called the Committee on the Review of Clinical Guidance for the Care of Health Conditions Identified by the Camp Lejeune Legislation .

The VA Committee was composed of leading experts in the relevant medical and scientific fields. The VA Committee was tasked with doing a comprehensive review of all the available scientific studies and research regarding the health impact of exposure to the chemical solvents in the Camp Lejeune Water supply. Based on this review, the VA Committee determined what specific diseases and health conditions could be linked to the Camp Lejeune water supply based on reliable evidence.

Paraquat Lawsuit Update For May 16 2022

The Plan To Push Paraquat Lawsuits To Trial

The judge in the Paraquat Parkinsons disease class action lawsuit issued a case management order that sets the game plan to select the lawsuits that will be the first to go to trial in this litigation. The plan is to pick out sixteen Paraquat lawsuits. Each side gets to pick half of the cases, subject to eligibility requirements set by the MDL judge.

Then, the lawyers start working up these lawsuits for trial. That involves the discovery process, the fact-finding mission attorneys go to before trial.

This all pushes towards a trial date in March 2023. Does this feel like a long time from now? If you have Parkinsons disease and you believe Paraquat caused your Parkinsons, it seems a long way from a settlement and the justice you deserve. This is the nature of the beast in mass tort lawsuits. This is the best and only path.

How Does Paraquat Exposure Happen

Paraquat Lawsuit

Paraquat is a restricted-use herbicide. This means only licensed, trained applicators can use it, and its not licensed for home use. Most people exposed to paraquat work in commercial agriculture or live near commercial farms.

The most deadly form of paraquat exposure happens if people eat or drink it. Exposure also happens through the skin or by inhaling it.

Long-term exposure to smaller amounts that can cause Parkinsons disease or other health problems occurs over years of working with or near the herbicide. This includes mixing, spraying, loading or cleaning.

People who live near farms may be exposed through spray drift or contaminated water. People who are married to or live with licensed applicators may be exposed through contaminated clothing or equipment and by accompanying applicators to work sites.
